Article 1. Purpose
These Terms set out the rights, obligations and responsibilities between HyperReality Co., Ltd. (the "Company") and members regarding the use of Fooding (푸딩, the "Service").
Article 2. Definitions
- A "member" is a person who has agreed to these Terms and created an account. "Diner members" find restaurants, join waitlists and book visits; "owner members" run restaurants.
- A "restaurant" is a business an owner member registers on the Service. A "guest waitlist user" is someone who joins a waitlist without an account, for example at a restaurant's kiosk.
- "Content" means reviews, photos and comments posted by members, and restaurant information, menus and posts published by owner members.
- "Paid services" means paid plans and add-ons for restaurant owners.
- "AI features" means features that produce output using generative artificial intelligence.
- "Access tokens" are not currently issued by the Service. If we introduce them, we will amend these Terms and notify you.
Article 3. Posting and Amending These Terms
- We post these Terms on a page linked from the bottom of the Service's home screen.
- We may amend these Terms to the extent permitted by applicable law.
- When we amend these Terms, we announce the effective date and the reason on the Service at least 7 days in advance. Changes unfavorable to members are announced at least 30 days in advance and also notified individually by email or in-app notification.
- If you do not agree to the amended Terms, you may terminate your agreement before the effective date. If we clearly stated in the notice that not objecting by the effective date will be treated as consent, and you do not object, you are deemed to have agreed to the amended Terms.
- Earlier versions are available under "Previous versions" at the bottom of this page.
Article 4. Formation of the Agreement
- The agreement is formed when an applicant reviews these Terms and the Privacy Policy, signs in with a Kakao, Naver, Google or Apple account (owner members may also sign up with email), and the Company accepts the application.
- Children under 14 may not sign up.
- We may refuse an application, or later terminate the agreement, if someone else's information was used or if the applicant's account was previously terminated for violating these Terms.
- An owner member who signs up on behalf of a company or other business represents that they are authorized to accept these Terms for that business.
- These Terms apply to guest waitlist users to the extent needed to register a waitlist entry.
Article 5. Account Security
- Members must keep their account and password from being used by others.
- If your account is compromised, or you suspect it is, change your password immediately and let us know.
- For security, we may block sign-in to an account suspected of misuse without prior notice, and will notify you promptly afterwards.
- Actions taken on a restaurant device (tablet or POS) that is signed in are treated as actions of the owner member who registered that device.
Article 6. Providing and Changing the Service
- We provide the following:
- For diners: restaurant discovery, search and maps; waitlists and bookings (visit plans); reviews and photos; bookmarks; rewards and coupons
- For owners: restaurant and menu management, waitlist management and kiosk, booking management, review replies, rewards and coupons, POS, and automatic menu translation
- We aim to run the Service 24 hours a day, every day of the year, but we do not guarantee uninterrupted service.
- We announce scheduled maintenance 7 days in advance. Emergency incident response or security measures may be announced afterwards.
- If we change or remove a major feature in a way that disadvantages paying members, we give 30 days' notice and refund the remaining period to members who cancel for that reason.
- If we shut down the Service, we give 90 days' notice and let owner members download their restaurant information.
Article 7. Paid Services and Payment
- The diner service (restaurant discovery, waitlists, bookings, reviews and rewards) is free. You pay for food at the restaurant, directly to the restaurant; the Company is not involved in that payment.
- The details and prices of paid services for owners are shown on the Service's pricing screen.
- Domestic payments (Korea): The Company is the seller. Payments are processed by a payment service provider engaged by the Company, and the Company issues tax invoices and receipts.
- Overseas payments: Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle's buyer terms also apply to overseas payments, and Paddle handles receipts and taxes.
- Subscriptions renew automatically for the same period (monthly or yearly) until you cancel, and are charged to your registered payment method on the renewal date. The checkout screen shows the amount, billing period, next billing date and how to cancel.
- Before a free trial converts to paid, or before a recurring price increases, we notify you at least 30 days in advance of the date, amount, payment method and how to cancel, and ask for your separate consent. Without your consent, there is no automatic conversion or increase.
- You can cancel from the billing settings screen, with a process as simple as signing up.
- Refunds are governed by our separate Refund Policy.
Article 8. Content and Restaurant Information
- Rights in reviews, photos and comments belong to the member who wrote them; rights in restaurant information, menus and posts belong to the owner member who published them.
- Members grant the Company a free license to display, search and recommend their content within the Service, and to feature it in promotional screens for the Service with attribution (nickname or restaurant name), to the extent needed for those purposes. The license ends when you delete the content.
- The Company processes content only to provide the Service, respond to incidents, maintain security and comply with the law.
- Owner members must publish accurate restaurant information, menus, prices and opening hours and keep them up to date. Disputes with diners caused by inaccurate restaurant information are the restaurant's responsibility, except where caused by the Company's intent or negligence.
- Food and service, waitlist calls and seating, no-shows, and payment are matters between the restaurant and the diner, and the Company is not a party to them. If a dispute arises, we help resolve it, for example by checking records.
- When the agreement ends, we let the owner member download restaurant information for 30 days and then delete it.
Article 9. AI Features
- Automatic menu translation (translating menu names and descriptions registered by owner members into Japanese and English) uses generative artificial intelligence. Its output is labeled as AI-generated.
- AI output can be inaccurate or incomplete. Owner members should check translations and correct them where needed; the Company does not guarantee the accuracy of the output.
- To the extent the Company holds rights in the output, they belong to the owner member.
- Members must not enter content that infringes others' rights or violates the law into AI features.
- The Service does not offer a way to connect your own AI provider account or key.
Article 10. Third-party Services
- When you sign in with a Kakao, Naver, Google or Apple account, we receive your email address from that service. That account is governed by the service's own terms.
- Map screens use Kakao Map. Sign-in or map features may be limited by outages or policy changes at those services.
- If you allow location access on your device, the Service uses your current location to find nearby restaurants. We do not store your location on our servers, and if you turn the permission off you can choose an area manually.
Article 11. Prohibited Conduct
Members must not:
- Violate the law or infringe others' rights (intellectual property, personal information, reputation, etc.)
- Send spam, phish, defraud or distribute malware
- Bypass or probe the Service's security, or try to access other restaurants' or members' data
- Scrape the Service at scale by automated means without permission, or overload the Service with excessive requests
- Copy or resell the Service, or reverse-engineer it to build a competing service
- Use AI features to create deepfakes or other content that deceives or harms people
- Post reviews of restaurants they have not visited, post paid reviews without disclosing it, or post false reviews to disparage competing restaurants
- Buy or sell waitlist or booking spots, register waitlists or rewards with someone else's phone number, or earn or use rewards and coupons fraudulently
Article 12. Restrictions
- If a member violates Article 11, we may take action in this order: warning, hiding content, limiting features, temporary suspension, and termination.
- If there is a risk of immediate harm to other members or the Service, we may suspend first and notify afterwards.
- Content reported as infringing someone's rights may be hidden temporarily while we review it.
- Members may object to an action, and we will promptly lift it if the objection is justified.
Article 13. Intellectual Property
- Rights in the Service and its software, design and trademarks belong to the Company.
- The Company grants members a non-exclusive right to use the Service under these Terms.
- The Company may freely use feedback and suggestions sent by members to improve the Service.
Article 14. Termination
- Members can request account deletion at any time from Settings → "Delete account" in the app. The last owner member of a restaurant can leave after transferring the restaurant or requesting its closure.
- If you delete your account while on a paid plan, the Refund Policy applies.
- Remaining reward points and coupons expire when the account is deleted. We tell you this on the account deletion screen beforehand.
Article 15. Limitation of Liability
- The Company is not liable for damage caused by natural disasters, the member's own fault, or outages of third-party services beyond the Company's control. However, where the Company's intent or negligence also contributed, the Company is liable to that extent.
- Unless caused by the Company's intent or gross negligence, the Company's liability to an owner member in connection with these Terms is limited to the total fees that member paid the Company in the 12 months before the damage occurred.
- Members who cause damage to the Company by violating these Terms must compensate the Company.
Article 16. Notices
We send notices to your account email, by in-app notification, or by announcement on the Service. Notices to all members may be given by posting on the Service for at least 7 days.
Article 17. Governing Law and Jurisdiction
- These Terms are governed by the laws of the Republic of Korea.
- Disputes are resolved in the court with jurisdiction under the Civil Procedure Act. A member who is a consumer may also bring a claim in the court for the member's place of residence.

Addendum
- These Terms take effect on 2026-10-16.
- This revision aligns the refund wording in the summary with the 2026-10-16 Refund Policy (full refund of every payment within 30 days). It is favorable to members, and no paid services had been sold when it was made, so no member is adversely affected; it therefore takes effect without the advance notice period in Article 3(3).
